Terms of Service
These terms apply to all users of the service (hereinafter "users") with respect to the use of the video chat system on the website "Buiken" (hereinafter "this site") provided by MAEMO LLC (hereinafter "we" or "our company"), and the internet communication service for various content that we distribute and receive (hereinafter "the service").
Users shall use the service after accepting all of the following provisions.
Please note that this service contains adult content, and viewing or using the service by anyone under 18 is strictly prohibited.
Article 1 (Scope and Amendment of These Terms)
The various regulations that we announce from time to time through this site constitute part of these terms.
We may change these terms and regulations, including the fee rules, at any time without obtaining the user's consent, by displaying the change on this site, and the revised terms will apply.
Article 2 (Content of the Service)
This service lets you enjoy messages and calls within the service only; it is not a service that provides actual meetings, dates or romantic relationships. This service aims at letting you enjoy communication with chat ladies. A chat lady is a real female member who earns an incentive each time she provides service to male members. Chat ladies have submitted official ID before using this service, and we have confirmed that they are 18 or older.
This service strictly prohibits use by persons under 18.
Article 3 (Eligibility and Approval)
Persons under 18 cannot use this service.
We review applications to use the service and grant use. If an applicant falls under any of the following, we may not approve membership.
Where the membership application is found to contain falsehoods, errors or omissions.
Where the applicant is found to have previously been expelled for violating these terms, etc.
Where the applicant has previously delayed or refused to perform an obligation to pay service fees, etc.
Where use of the credit card or payment account designated by the applicant has been suspended by a credit card company, financial institution, etc.
Where the applicant is a minor.
Where we otherwise judge the applicant unsuitable as a user.
Article 4 (Equipment)
Users shall procure and maintain, at their own expense, the mobile devices and equipment necessary to use the service.
Article 5 (Fees and Points Issued)
The service fees and payment methods shall, in addition to these terms, follow the fee rules separately determined by us and displayed on this site.
Users shall bear consumption tax and any other taxes imposed on fees, etc. Bank transfer fees and all other costs shall also be borne by the user.
Article 6 (Payment of Fees)

Article 7 (Warranties and Liability for the Service)
We will take sufficient care to provide the service smoothly, but we bear no responsibility whatsoever if a user cannot use the service due to computer viruses, hacking, equipment failure, line abnormalities, unstable power supply, natural disasters, incidents, accidents such as fire, or other force majeure.
When using content, users agree to judge its reliability, accuracy, completeness, usefulness, etc. themselves and to do so at their own responsibility and risk. We bear no responsibility whatsoever for the content provided by performers.
We do not guarantee the quality, accuracy, etc. of information, products, sweepstakes, prizes, etc. provided through the service.
We are not liable for compensation for damage caused directly or indirectly to users or third parties by delay, non-performance or suspension of the service.
If provision of the service is suspended, we will strive to restore it promptly, but we make no guarantee whatsoever regarding the restoration time.

We make maximum efforts regarding site maintenance and security, but we bear no responsibility whatsoever for harm or damage suffered by service users due to virus infection or hacking caused by force majeure.
Even if a user accesses another network via this service, we shall not be responsible for any trouble arising between that user and the organizer of the other network, users of the other network, or other third parties, and if we or a third party suffers damage as a result, the user shall compensate for it.
Article 8 (Changes, Interruption or Suspension of the Service)
The service may be interrupted or suspended if any of the following applies.
Where unavoidable due to maintenance of our telecommunications equipment or various construction work.
Where there are unavoidable reasons such as failure of the equipment and systems for the service.
Where there are unavoidable reasons at our discretion.
Whatever the reason for a change, delay, interruption or suspension of the service, we bear no responsibility whatsoever for damage suffered by users or third parties as a result.
For our own reasons, we may change, temporarily interrupt or suspend all or part of the operation of this site without prior notice to its members.
Article 9 (Discontinuation of the Service)
We may discontinue the service by giving prior notice on this site. Such notice shall be given at least one week before the discontinuation.
Whatever the reason the service is discontinued, we bear no responsibility whatsoever for damage suffered by users or third parties as a result.
Article 10 (Prohibition of Diversion of the Service)
Users may not, by any means, divert all or part of the service or data related to the service to others, provide or let third parties use it, or use it for the business of themselves or third parties.
Article 11 (Copyright)
Users of this site may not, by any means, use any information provided through this site outside the scope of the member's private use as defined by the Copyright Act.
If a problem arises from a violation of this Article, this site and our company shall resolve the problem at their own expense and responsibility and shall not cause any inconvenience or damage to our company.
Article 12 (Handling of Information)
The copyrights in the information, advertisements and various content provided to users through the service all belong to us.
Information that users register with the service belongs to us.
We shall not provide users' personal information learned in connection with the service to third parties without the user's prior approval. Article 13 (Prohibited Acts)
Users of this site shall not engage in any of the following acts when using this site.
Acts that infringe, or may infringe, the copyrights, trade secrets, publicity rights or other rights of other users, performers, third parties or our company.
Acts that infringe, or may infringe, the property, privacy, human rights or honor of other users, performers, third parties or our company.
Acts that cause, or may cause, disadvantage or damage to other users, performers, third parties or our company.
Acts of directing people to other sites.
Acts of communicating or exchanging personal contact information.
Acts of using the service for the purpose of meeting people, etc.
Acts that interfere with the operation of this site.
Acts that damage the credibility of this site.
Unauthorized use of an ID or password.
Acts in which a user exposes his genitals to a performer using still images, video, or two-way streaming during chat.
Acts that are, or may be, contrary to public order and morals.
Criminal acts, acts connected to criminal acts, or acts that may be such.
Any other act that violates, or may violate, laws and regulations.
Any other act that we deem inappropriate.
If a user of this site causes damage to another user or a third party through use of the service, that user shall resolve it at their own responsibility and expense and shall not cause damage to our company.
If a user of this site causes damage to our company in violation of this Article, we may claim compensation from that user.
Article 14 (Deletion of Inappropriate Registered Information)
If we determine that the content of text or the like registered on this site falls under, or may fall under, the preceding Article, we may delete the relevant content or information without notifying the user.
Article 15 (Temporary Suspension of ID, Deletion of ID, and Cancellation of Membership Registration)
If we determine that a user falls under any of the following, we may temporarily suspend or suspend use of the ID, revoke membership and expel the user, without any prior demand or notice to that user.
Where there is any falsehood in what was reported or notified to us.
Where the connection-time limit for member-only pages set by us has been reached.
Where payment has been neglected for 10 days or more after the invoice for service fees was sent.
Where the user has delayed or refused to perform the obligation to pay service fees.
Where the contact email address provided at registration becomes unable to receive mail due to cancellation, change, etc.
Where the same person has registered as a member more than once.
Where an ID or password was used without authorization.
Where there has been inappropriate conduct toward performers on this site.
Where illegal acts were committed using the service.
Where any of these terms was violated.
Where we otherwise judge the user to be unsuitable, or that continuing membership is difficult.
When a user is expelled, the benefit of time is forfeited and all fees and the like incurred up to expulsion shall be paid immediately in a lump sum.
We will not refund any fees already paid by an expelled user.
If we suffer damage due to the acts of a user falling under the preceding paragraph, we may claim compensation for such damage from the user regardless of whether the ID was suspended or the user expelled.
Article 16 (Disclaimer)
We bear no responsibility whatsoever for any damage to users arising from use of the service, and have no obligation to compensate for such damage.
If a user causes damage to a third party through use of the service, the user shall resolve it at their own responsibility and expense and shall not cause damage to our company.
If a user causes damage to our company through acts that violate these terms or through fraudulent or illegal acts, we may, after consulting with the relevant authorities, claim appropriate compensation from that user.
Article 17 (Obligations)
If we find posts that damage the credibility or image of this site, or other acts that hinder the maintenance of operations, we may claim damages in writing through the courts, etc. Also, if the police, courts, etc. request disclosure of data under laws concerning public order and morals, we will comply promptly.
Article 18 (Governing Law and Jurisdiction)
Japanese law shall apply to legal matters between us and users.
Disputes, claims, breaches of contract and the like arising from or in connection with this agreement shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Article 19 (Term of These Terms)
These terms are valid at all times during the period in which we provide the service.
